In April, 1923, C. H. Rosenbaum desired to purchase certain real estate, ^including the dwelling thereon, which belonged to the estate of James S. Patten, deceased, in the city of Des Moines, Iowa. The purchase price of the real estate was $20,000, of which $8,000 was paid in cash. Said Rosenbaum, for private reasons, did not desire to sign the mortgage for $12,000, representing the balance of the purchase price.
