Action in replevin. Yerdiet.for plaintiff, defendant appeals. We will hereafter refer to the parties as plaintiff and defendant. ,

Plaintiff’s petition- alleged that he was the owner of a 1948 Chevrolet, Sedan (describing it) of the value of $1900.00. That he delivered the-sedan to defendant, who was a registered dealer in motor vehicles, who ■ was to sell it and they were to divide the profits. It was further alleged, that defendant failed to sell it and also failed .to return.it to plaintiff, although demand -had-been made for the returp of it- on or *563about tbe 1st day of November, 1948.
