EVANS, J.

Defendant United Pacific Insurance Company appeals from an order denying in part a motion for new trial made pursuant to section 914 of the Code of Civil Procedure, 1 and from the judgment entered in favor of plaintiff J. David Hennigan. Plaintiff Hennigan cross-appeals from the order granting the partial new trial.
