MEMORANDUM OPINION

This case is before the court on the motion of Dr. Arthur Herbst to quash a deposition subpoena directed to him which calls for the production of various research materials in his custody.1

*496The deposition subpoena was served on Dr. Herbst by E.R. Squibb & Sons, Inc. (“Squibb”), pursuant to Fed.R.Civ.P. 45. Squibb has been sued by Paul Renfroe and Nancy Deitchman (“plaintiffs”) in two separate cases brought in the United States District Court for the Eastern District of Missouri, Eastern Division.
