¶31 (dissenting) — The majority fails to give effect to the parties’ contractual agreement to arbitrate under the National Association of Securities Dealers (NASD) Code of Arbitration Procedure (Code). The problem with the majority’s approach is that NASD Code section 10304 expressly addresses time limitations and NASD Code section 10324 expressly grants the power to the arbitrators to interpret and apply all provisions under the NASD Code.
