I. Introduction.

On the evening of September 17, 2001, a police pursuit of armed suspects ended with the shooting death of a police officer and, in a ease of mistaken identity, the non-fatal shooting by police of a civilian witness. That witness, Plaintiff Stephen R. Flynn, filed the instant action claiming, among other things, unreasonable seizure and the use of excessive force in violation of his constitutional rights.
