Before the Court is Defendant GuideOne Elite Insurance Company’s Motion for Partial Summary Adjudication [Doc. No. 132]. 1 Despite the caption, Defendant seeks a determination as a matter of law pursuant to Fed.R.Civ.P. 56 that Plaintiffs only remaining claim — a tort claim of insurer’s bad faith — is barred by the statute of limitations. 2 Plaintiff has opposed the motion, and Defendant has filed a reply brief. The Motion is thus at issue.
