This is a declaratory judgment action which presents several issues of first impression in the State of New York. The action was commenced by Kansas City Fire and Marine Insurance Company ("Kansas City”) to determine, among other things, its obligation to defend and provide insurance coverage to defendants Chautauqua Transit, Inc. and Harold E. Vincent in a personal injury action arising out of an accident which occurred in Erie County on June 24, 1970.
