In an action in the United States District Court for the Western District of New York, plaintiff recovered a judgment against one McPerran, a citizen of Ohio, for damages arising out of an automobile accident which occurred in the State of New York. At the time of the accident the truck was being operated by McPerran, but in the business of Central States Transportation Co., Inc., a Massachusetts corporation, pursuant to a one-year lease from McPerran, the registered owner of the truck.
