MEMORANDUM OPINION AND ORDER
FILIP, District Judge.
David Jacobs (“Jacobs” or “Plaintiff”) brings this action against the Xerox Corporation Long Term Disability Income Plan (“Plan” or “Defendant”). Plaintiff has filed a three-count second amended complaint. (D.E.10.) In Count I, Plaintiff alleges that he has been wrongfully denied long-term disability (“LTD”) benefits in violation of § 502(a)(1)(B) of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1182(a)(1)(B) (“Section 502”).
