Action in the district conrt for Stearns county by the special admin-istratrix of the estate of Nathan E. White, deceased, to recover $25,000 for the death of her intestate. The answer alleged contributory negligence on the part of decedent. The case was tried before Eoeser, J., who at the close of the testimony denied defendant’s motion for a directed verdict, and a jury which returned a verdict for $5,500. Defendant’s motion for judgment notwithstanding the verdict was denied. From the judgment entered pursuant to the verdict, defendant appealed.

Action to recover for the death of plaintiffs intestate which occurred on one of defendant’s freight trains at Melrose in this state as the result of alleged negligence on the part of the defendant company. The plaintiff recovered a verdict for $5,500, and from an order denying its motion for judgment notwithstanding the verdict defendant appeals.
