Suit by appellant to have a deed declared a mortgage and for an accounting. In appellant’s complaint, filed in the Howard Circuit Court, against the appellees, Rufus A. Layman and Etta M. Layman, his wife, she alleged that she was the sole owner of certain real estate in the city of Kokomo; that said Rufus Layman had the possession of same finder a deed which deed was, in truth and fact, a mortgage.
