This is a condemnation proceeding, and involves the right of the petitioner, the Department of Highways and Public Works of the State of Tennessee, in advance of any action taken upon the report of the jury of view, to take a nonsuit upon an abandonment of the project of acquiring certain portions of defendant’s land, to be used as gravel pits, from which the State would obtain material for use on its highways., The petition was filed in the circuit court of Cocke county by the said Department of Highways, through its Commissioner, J.
