Upon an appeal from a decree of the General Court.

1Opinion of the Court

Pelham was complainant in the court below, therefore his entry ought to be first investigated. It is as followeth, viz : “ January 7th, 1783. Charles Pelham, assignee, etc., enters one thousand acres, etc., beginning at the south-east corner of John Williams’s settlement and pre-emption, where John Marshall joins him with five hundred acres on the waters of the south fork of Elkhorn, running with his line north-west to the extremity thereof, thence at right angles for quantity.” At the time this entry was made it appears that Williams had obtained a certificate from the commissioners for a…
