The appellant commenced her action in the superior court of Marion county against the appellee to recover damages on account of personal injuries alleged to have been caused by the negligence of appellee. The venue was changed to the circuit court *141of Morgan county, where there was a trial which resulted in a verdict and judgment for appellant for $3,000. Appellee after term filed its application in the office of the clerk of the Morgan Circuit Court for a new trial on account of newly-discovered evidence.
