Defendant, Richard Howard Hunt, was convicted by a jury of assault with a deadly weapon inflicting serious injury, and was sentenced to three years imprisonment. On appeal, defendant presents two issues: (1) whether the trial court erred in allowing a police officer to demonstrate the operation of a weapon which was not in substantially the same condition as it was in at the time of the alleged assault and to render an opinion that the weapon could only be discharged if the hammer was cocked and the trigger pulled, and (2) whether the trial court’s order of restitution is…
