— The appellees, as trustees of the Presbyterian Church of Aurora, Indiana, brought this action against the appellants to recover in-lot one hundred and sixty-eight (168), in said city, and the church building thereon. The action was commenced in the Dearborn Circuit Court, and the venue was changed to the' Jennings Circuit Court. The complaint consisted of two paragraphs. The first was in the ordinary form for the recovery of real estate, and the second alleged specially all the facts upon which a recovery was sought.
