Appeal by defendant from a judgment of the Supreme Court, Kings County, rendered August 13, 1975 (the date on the clerk’s extract is October 8, 1975), convicting him of criminal sale of a dangerous drug in the third degree (two counts, upon a jury verdict, and imposing sentence. Judgment reversed, on the law and as a matter of discretion in the interest of justice, and new trial ordered. The defendant’s prior conviction was reversed and he was granted a new trial (People v Goggins, 42 AD2d 227, affd 34 NY2d 163, cert den 419 US 1012).
