MEMORANDUM OPINION

HIGHSMITH, District Judge.

This cause came before the Court upon Defendant Seaport Crane Service, Inc.’s (“Seaport”) Motion for Summary Judgment, filed August 26, 1993. For the reasons stated below, the Court denies Seaport’s motion for summary judgment.

INTRODUCTION

This is a consolidated action for damages, governed by the Longshore and Harbor Workers’ Compensation Act, 33 U.S.C. § 901 et seq., for personal injuries sustained by two longshoremen as a result of an accident aboard a vessel.
