MEMORANDUM AND ORDER

MURRIAN, United States Magistrate Judge.

This matter is before the undersigned in connection with the plaintiffs’ motion for a new trial pursuant to Fed.R.Civ.P. 59 [Doc. 38]. The defendant has responded and opposes the motion [Doc. 42]. Supplemental briefs were filed after oral argument was heard on January 14, 1999 [Docs. 45, 46]. The plaintiffs seek a new trial on the basis of inadequacy of the verdict. This case was tried before a jury on December 7 and 8, 1998, and resulted in a verdict in favor of the plaintiffs in the amount of $14,622.08 for plaintiff Robert Bivens,…
