Plaintiff, Rameo Industries, Inc., appeals from an order of the circuit court of Cook County granting the motion for partial summary judgment in favor of defendants Mellon-Stuart Company (Mellon-Stuart) and Seaboard Surety Company (Seaboard). The sole issue on appeal is whether the trial court erred in finding that plaintiff could not assert a mechanic’s lien pursuant to section 23 of the Mechanics Liens Act (Ill. Rev. Stat. 1987, ch. 82, par. 23) (the Act) against the Board of Trustees of the University of Illinois (the Board) in connection with a construction project.
