OPINION
DEBEVOISE, District Judge.
Plaintiff Charles E. Weber instituted this suit on January 8, 1982 alleging that defendant Heat Control Company violated the Davis-Bacon Act, 40 U.S.C. § 276a et seq., by failing to pay the prevailing wages for insulation work performed by the plaintiff. The defendant now seeks summary judgment in its favor on the grounds that the plaintiff lacks a private right of action under the Davis-Bacon Act (“Act”), that the plaintiff is an independent subcontractor and, therefore, falls outside the scope of the Act, that I lack jurisdiction to determine the plaintiff’s…
