Empresa Estatal Petróleos de Ecuador (“PetroEcuador”) contracted with BP Oil International, Ltd. (“BP”), for the purchase and transport of gasoline from Texas to Ecuador. PetroEcuador refused to accept delivery, so BP sold the gasoline at a loss. BP appeals a summary judgment dismissing PetroEcuador and Saybolt, Inc. (“Saybolt”), the company responsible for testing the gasoline at the port of departure. We affirm in part, reverse in part, and remand.
