This is an appeal from an order of the probate department of the Circuit Court of Multnomah County construing the will of Samuel H. Palmer, deceased. The proceeding was initiated by the petition of Veronica M. Erickson, the decedent’s daughter, praying for a construction of the testator’s will which would determine the petitioner’s rights thereunder, and particularly by adjudging her to be the testator’s sole heir at law and owner in fee of the parcel of real property described in paragraph VII of her father’s testa ment.
