Appeal from a judgment of the superior court for Chehalis county, Morris, J., entered May 21, 1908, upon the verdict of a jury rendered in favor of the defendant, in an action of ejectment.

This is an action brought by the appellants to recover from the respondent possession of certain real property, and the rental value of the same while they were deprived of its use by the acts of the respondent. In their complaint the appellants allege that they are the owners, by purchase from the state of Washington, of the southeast quarter of section sixteen, in township eighteen, north, of range eleven, west, of the Willamette Meridian, together with the banks of the Humptulips river within the boundaries of such lands, and the shore lands, shore lines and shore rights thereunto…
