This case involves the initiative process. The plaintiff seeks judicial review of an order in other than a contested case, ORS 183.484, as well as a declaratory judgment, ORS 246.910 and ORS 28.010. In March 1989, the Secretary of State approved a specific form of initiative petition for circulation to obtain signatures on Ballot Measure 5. Thereafter, the legislature amended the law to require that initiative petition signature sheets show whether paid circulators were being used to collect signatures.
