I. INTRODUCTION

This matter is before the Court on cross-motions for summary judgment arising out of Plaintiff Keith Stubl’s Complaint alleging that Defendants violated his rights under the Family and Medical Leave Act of 1993, 29 U.S.C. § 2601, et seq. (hereinafter “the Act” or “FMLA”). In Count I of his Complaint, Plaintiff names as Defendants T.A.
