I. INTRODUCTION

Plaintiffs Robert and Robin Zollinger (“plaintiffs”) commenced the instant per sonal injury action against Defendant Owens-Brockway Glass Container, Inc. arising out of a forklift accident whereby Robert Zollinger’s (“Zollinger” or “plaintiff’) left foot was injured. Plaintiffs now move for partial summary judgment seeking to (1) preclude defendant from asserting a seat belt defense and otherwise mentioning the use (or non-use) of a seat belt at trial; (2) dismissing defendant’s defense pursuant to New York Civil Practice Law…
