HERTZ, Acting Justice.
This is an appeal from a judgment denying rescission of a license agreement and addendum for purchase. George Kane, plaintiff and appellant (Kane), initiated this action seeking both rescission of the agreements, and damages for sellers fraudulent conduct. Detlef and Faith Schnitzler (Schnitzlers), defendants and appellees, counterclaimed alternatively for damages or specific performance pursuant to Kane’s breach of an assignment for sublease.
