BACKGROUND
On June 19, 2003, Touch America Holdings, Inc. et al. (the “Debtors”) filed voluntary petitions for relief under chapter 11 of the United States Bankruptcy Code with the United States Bankruptcy Court for the District of Delaware (the “Court”). The Debtor’s Amended Liquidating Chapter 11 Plan (docket no. 1853)(the “Plan”), filed on August 17, 2004, was confirmed by Order of the Court dated October 6, 2004 (docket no. 2172). Brent C.
