MEMORANDUM OPINION AND ORDER
SIDNEY A. FITZWATER, District Judge.
In this removed action, the dispositive question presented is whether the defendant-counterplaintiff-third-party plaintiff has established a viable claim for relief under the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. §§ 1961-1968 (“RICO”). Concluding that she. has not, the court grants plaintiff-counterdefendant’s and third-party defendants’ motions for summary judgment dis missing the RICO claim and remands the balance of the case to state court.
