This case comes from the county court of Garvin county, and is a suit on a promissory note. Execution and delivery’ by maker, and also in-dorsement and delivery by payee to plaintiff, admitted.
Defendant answers, in substance and effect, that prior to indorsement and delivery by the payee to plaintiff of the note sued on consideration failed, in that the contract between the defendant (maker) and payee (in-dorser) was canceled by mutual agreement, which facts were known to the plaintiff (in-dorsee) prior to the time he purchased or obtained the note from the payee.
