ROGERS, Circuit Judge.
This action was brought to recovet damages for personal injuries arising out pf the alleged negligence *624of the defendant. A verdict was returned in favor of the plaintiff and against the defendant for $10,000, and judgment was entered for $10,105.35, damages and costs.
[1] The plaintiff was a deck hand employed by the Pure Oil Company on one of its barges—loaded with oil in bulk. The oil, which had been sold to the defendant, was being pumped from the barge directly into one of defendant’s tanks. In all such transactions the .custom is to have the contents of the tank…
