While on defendant’s premises at Tolleson, Maricopa county, plaintiff came in contact with a piece of machinery being- used and operated by defendant and was injured. He sued the defendant charging negligence in the respects hereinafter stated. The defendant answered by a general denial, contributory negligence and assumed risk. A trial before a jury was had which resulted in a verdict and judgment in favor of the plaintiff. Defendant appeals.
