Plaintiff, father and personal representative of Raymond D. Pelkey, deceased, appeals from a judgment entered by the Superior Court (Penobscot County, Smith, J.) following a jury verdict finding for defendant, Canadian Pacific Limited (“Canadian Pacific”), in a wrongful death action involving a collision between an automobile and a freight train. Plaintiff contends that the Superior Court failed to properly instruct the jury as to the defendant’s duty of care and improperly excluded testimony by three of plaintiff’s witnesses.
