Plaintiff United States of America (hereinafter “the government”) brings this claim for civil forfeiture, pursuant to 18 U.S.C. § 981, of securities which allegedly represent the proceeds of transactions “structured” to avoid federal reporting requirements in violation of 31 U.S.C. § 5324(3). The action is presently before the Court on claimants’ motion for dismissal of the complaint or for summary judgment pursuant to Rules 12 and 56, Fed.R.Civ.P.
