This was an action for damages brought by Joseph P. Roetzel, who will be referred to as plaintiff, against W. R. Kelly, who will be referred to as defendant. Verdict was for plaintiff, and defendant appeals.
Defendant filed application for disqualification of the presiding judge of the district court of Blaine county on the alleged ground of prejudice in favor of plaintiff. This application was denied, whereupon the court announced that he would retire from the bench if counsel could agree on another Judge to try the case.
