| Appellant Ronald Wayne Magness appeals his conviction of escape in the second degree pursuant to Arkansas Code Annotated section 5-54-lll(a)(2) (Supp.2009). The court of appeals certified this case as involving an issue of first impression and a substantial question of law concerning the validity, construction, or interpretation of an act of the Arkansas General Assembly.
