MEMORANDUM and ORDER

DOOLING, District Judge.

Plaintiff moves in a patent suit for a preliminary injunction. The determinative facts are undisputed.

The patent involved is United States Patent No. 2,724,720, issued November 22, 1955, on an application filed August 3, 1953. Claim 4 of the patent is upon a therapeutic agent called meprobamate, a drug used in the treatment of disorders of the central nervous system, and among other purposes, as a tranquilizer.
