This is an action for an alleged infringement of plaintiff’s U. S. Patent No. 2,742,462 issued to plaintiff on April 17, 1956. This court has jurisdiction under Title 28, U.S.C.A. section 1338(a) and venue is based upon 28 U.S.C.A. section 1400(b), this district being where the alleged acts of infringement have been and are taking place.
