OPINION
POGUE, Judge.
In this action, the United States Bureau of Customs and Border Protection (“Customs”) seeks civil penalties from Rockwell Automation Incorporated (“Rockwell”) because of Rockwell’s alleged improper entry of merchandise into the U.S. Immediately before the court is Customs’ motion for partial summary judgment; in response, Rockwell seeks dismissal, or, in the alternative, summary judgment in its favor.
