The parties to this action-will be designated as in the trial court. W. H. Pruitt, as plaintiff, instituted this action in the district court of Pottawatomie county, Okla., against the Chicago-, Rock Island & iPacüfijc (Railway fcompany, for damages for personal injuries alleged to have been sustained by him while in the employ of the defendant company. The-plaintiff’s petition charged, in substance, that while in the employ of the defendant company, in the capacity of truckman helper, he was injured by reason of a shaker bar slipping from a grate on one of the defendant company’s engines,…
