This suit for personal injuries was originally filed and tried in the United States Court for the Northern District of Indian Territory resulting in a judgment for the plaintiff. An appeal was prosecuted to the Court of Appeals of Indian Territory; an opinion being rendered by the said court reversing the judgment. of the trial court on the ground that the defendant railway company should have had an instructed verdict in its favor.
