This is an action to recover damages brought by appellee against appellant. Plaintiff’s amended petition, upon which the cause was tried in the court below, alleges that plaintiff is now and has been since April 20, 1901, the owner of lots numbers seven (7) to twelve (12) in block one hundred and twenty-seven (127) in the town of Bay City, said lots fronting three hundred (300) feet on Avenue J in said town.
