Appeal by the defendant from a judgment of the County Court, Nassau County (Thorp, J.), rendered April 22, 1986, convicting him of criminal possession of a weapon in the third degree, operating a motor vehicle while impaired, speeding (two counts), and driving without lights, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed, and the case is remitted to the County Court, Nassau County, for further proceedings pursuant to CPL 460.50 (5).
