Pending before the Court is an appeal by Creditor United States of America on behalf of the Internal Revenue Service (“IRS”) from the Bankruptcy Court’s memorandum opinion granting Debtor’s (Kemendo’s) motion for summary judgment and denying the United States of America’s motion for summary judgment regarding a discharge of debts under 11 U.S.C. §§ 1328(a) and 523(a)(1)(B).
