This matter comes before the Court on motion for summary judgment by defendants Topeo Financial Services, Inc. and Tracey and Jane Doe Austell (collectively “defendants”) (Dkt. No. 13), plaintiffs’ cross-motion for partial summary judgment (Dkt. No. 15), and defendants’ motion to strike plaintiffs’ cross-motion for partial summary judgment (Dkt. No. 18). The Court has considered the papers submitted by the parties and determined that oral argument is not necessary.
