On June 8, 1959, the Court of Appeals remanded this case to the District Court for further proceedings (4 Cir., 268 F.2d 27, 1959 A.M.C. 1342). The scope of the remand was limited to consideration of the following questions: 1. With respect to the gear rack used to elevate the bascule span, was its protrusion approximately 18 inches beyond the face of its concrete pier housing, but some 3% feet shoreward of the channel face of the protective fender line, a violation of the permit issued by the War Department for the construction of the Ashley River Bridge? 2.
