MILLER, Chief Justice:
Matthew Junior Miller was convicted by a jury in the Circuit Court of Upshur County of kidnapping and first degree sexual assault. He was sentenced to life with mercy for the kidnapping and to ten to twenty years for the sexual assault, with the sentences to be served concurrently. In his appeal, the defendant argues that it was a violation of double jeopardy principles for him to be convicted of both kidnapping and first degree sexual assault.
