Appeal from a judgment of the County Court of Broome County (Coutant, J.), rendered February 27, 1981, upon a verdict convicting defendant of the crimes of robbery in the first degree and attempted robbery in the first degree. At 3:30 a.m. on April 15,1980, two men entered a Hess gas station in the Town of Vestal. One of the men pointed what appeared to be a pistol at the station attendant and demanded money, while the other ripped out the cord of the public telephone outside the station office.
